SPLC Vs Eugene Delgaudio & Public Advocate US
Hill v. PAUS Complaint - Filed 092612
Well, this is awesome! In case you’re not familiar with this case, Hate Group “Public Advocate US” used a photo of a gay couple kissing to promote their anti-gay agenda in Colorado against State Senators that supported civil partnerships for gay and lesbian couples. The thing is, that picture (right) was used with out the couples consent nor the photographer’s license. So the Southern Poverty Law Center is seeking to take this sons of bitches to Court over two main issues:
The unlawful use of a copyrighted photograph, and
The damage of the image and human dignity of the couple on the photograph (Tom Privitere and Brian Edwards)

The whole thing is worth it of reading. This, to me, was the best part (it’s an excerpt of Exhibit A, a letter from SPLC’s Christine  P. Sun to PAUS’ Eugene Delgaudio):

[…] For years, “Public Advocate” has spread lies and vitriol about LGBT people to raise funds, impede progress toward greater equality, and to deny LGBT people basic dignity and respect. From the many regrettable examples that could be listed, “Public Advocate” has throughout the years: •       blamed “the homosexual agenda” for enhanced-passenger-search procedures at airports so that gay people can feel others up;•       compared marriage equality to bestiality through production of a “Man-Donkey Mock Wedding Ceremony”; •       defamed gay people as pedophiles and rapists to be feared, in reference, for example, to permitting gay scout masters, which is “the same as being an accessory to the rape of hundreds of boys”;•       demonized gay people and those suffering from AIDS as “prey[ing] on children to replenish the ‘Homo-sexual Community’”;• provoked readers through a fundraising letter to “imagine a world where the police allow homosexual adults to rape young boys in the streets”;•       promoted harmful, discredited conversion therapy as necessary and effective to rescue gay people from their orientation; and•               mischaracterized national legislation to address an epidemic of anti-LGBT harassment at schools as “requir[ing] schools to teach appalling homosexual acts…force private and even religious schools to teach a pro-homosexual agenda…ram through their entire perverted vision for a homosexual America….create a new America based on sexual promiscuity.” Because of these misrepresentations and numerous others, the Southern Poverty Law Center has previously designated “Public Advocate” as a hate group. […]

And this, ladies and gentlemen, is why the Southern Poverty Law Center names as Hate Groups organizations like Public Advocate US, Family Research Council, National Organization for Marriage, among others. Not because of ther religious beliefs nor their dislike of the LGBT Community, but for their lies and hate speech against us.

PS. Eugene Delgaudio is the President of the Public Advocates for the U.S. He can be reached at his email address: eugene@joineugene.com

This is State Senator Jean White, the one Public Advocate has been bitching about.  If you’d like to thank her for being a leader in the battle for equality, she can be reached at: senatorwhite2@gmail.com

United Arab Emirates: Men Jailed For Kissing
Emirates 24/7 reports:

An appeals court in Abu Dhabi upheld a previous court verdict and sentenced a European and an Asian man to six months in prison and ordered their deportation after they were convicted of kissing each other on the mouth in a public place, a newspaper reported on Wednesday. The court supported the previous sentence after a witness confirmed again that he saw them hugging and kissing each other on the mouth in a street in Abu Dhabi, the Arabic language daily Alittihad said. The two unnamed defendants again told court they were hugging each other while the European said he kissed his friend on the head as he was leaving the UAE.Their defence lawyer asked court to acquit them on the grounds the witness gave contradicting statements. The paper said a man who happened to be driving in the area saw the two hugging and kissing each other on the mouth. He told court that he was not first sure of what he had seen so he turned back and saw them kissing again.“The court sentenced them to six months in jail and ordered their deportation after serving their prison terms….they two were charged with committing an indecent act in a public place,” it said.

USA: Male Highschool Cheerleader Suspended, Kicked Off Squad For Same-Sex Kiss

Dan Savage reports:

I smell a big, fat lawsuit:

A male cheerleader said he was kicked off the squad and suspended after he was caught kissing another male student on campus. The young man spent countless hours practicing every day for years to make the varsity cheer squad, and he had it all taken away from him in an instant.
Perhaps most surprising, is the way the student was caught. Not in person by a teacher, but by surveillance camera, leading the young man to believe he was being watched and targeted by school officials simply because of his sexual orientation. “They never check cameras for anything unless something is stolen,” the young man said, asking not be indentified. “We would be the ones getting caught because I’m sure we were the only ones, sexual orientation wise, being caught like that.”

The boy said public displays of affection are a relatively common occurrence at Alice HS, and he believes that the principal would not have targeted him had he been caught kissing a female student. “In this school [kissing] is everywhere, if that were the case, suspending everyone for that, half the school would be suspended,” he said. The district superintendent told 6 News he couldn’t comment about the matter because of privacy issues. Now they’re concerned about this boy’s privacy? After spying on him, booting him off the cheerleading squad, and likely outing him to his family and peers in freethinking, tolerant Texas? Now administrators at Alice High are concerned about this boy’s privacy?

UPDATE: Slog tipper/flying monkey Ryan writes…“Just emailed Ms. Munoz and my message was rejected by a filter for ‘inappropriate language’! Thought that was interesting as my email was rather bland and certainly not offensive. I tried a few variations deleting various words and it eventually went through when I removed ‘sex’ (in ‘same sex kiss’).”

Ms. Munoz,
If the student’s allegations on 6 News are true regarding his suspension for a same sex kiss, then you have a large lawsuit coming your way fast. Actions like this are why kids across the country are killing themselves. I hope you’re enjoying the national exposure this incident is giving you and your high school.
If you look at the attitudes of Americans under 35, there is overwhelming support for LGBT rights and issues. Actions such as this suspension are already part of a nearly bygone era of intolerance and discrimination. Have fun residing in the history books next to Jim Crow and George Wallace.
If your email gets rejected… and you don’t want to edit or self-censor… you can call or fax Principal Munoz at…
Phone: 361-664-0126 | Fax: 361-660-2128
Go get ‘em.
UPDATE 2: It’s going national:Some other parents agreed the boy was being unfairly punished, KRIS reported. They told the station one cheerleader who had a child and another who is currently pregnant are still on the team and have not faced any disciplinary action.
Alice High School, a public school in South Texas, states in its student handbook that “the district believes that all students learn best in an environment free from dating violence, discrimination, harassment, and retaliation and that their welfare is best served when they are free from this prohibited conduct while attending school.”
Neither Superintendent Salvador Cavazos nor Alice High School Principal Lucy Munoz would speak to msnbc.com, and they haven’t spoken to other reporters, citing student privacy. Melonae Day, Alice’s assistant superintendent of business and human resources, who is listed as the district’s nondiscrimination representative on the basis of gender, also did not return a phone call from msnbc.com.
It’s a public school. I wonder how long it’ll take Principal Munoz to return the calls of the ACLU attorneys she’ll be hearing from in three, two, one…

Spain: When A Kiss Is a Popemobile Protest

The Advocate reports:

A gay couple lock in a kiss while the Popemobile passes through the streets of Madrid. They were what was left of a foiled “kiss-in” protesting the Roman Catholic Church’s “moral condemnations of sexuality,” according to a Facebook page used to organize.Hundreds of LGBT protesters planned to kiss while Pope Benedict XVI was en route through Madrid, but police blocked the protesters before they could meet up. The activists had planned to join up on the major artery Calle Serrano, along which the pope later traveled in his bulletproof white vehicle for a welcoming ceremony in Plaza Cibeles Square. — Lucas Grindley

PANAMA: Lesbian Couple Jailed For Kiss

Joe.My.God. reports:

Onscreen clip translation by Andres Duque at Blabbeando. He reports:

On Sunday, 32 year old Valentina Hernandez (right) and her 23 year old girlfriend were enjoying a romantic walk down the streets of the historic Casco Antigüo colonial district of Panama City when she stopped to give her girlfriend a kiss. Hernandez, a psychologist by profession, reached out to Panamanian newspaper Prensa and shared details of what followed. Hernandez says that a member of Panama’s presidential guard who had seen them kiss approached them and accused them of improper behavior. When Hernandez asked him to explain clearly which law they had violated, the guard grew exasperated and called for reinforcement. She says that ten other members of the Institutional Protective Service (S.P.I.) quickly showed up and took her ID and cell phone as they whisked the couple to the local police precinct. Hernandez says that, once they reached the precinct, she was given an intrusive body check by a policewoman. “I felt they touched me everywhere,” she said, “They rubbed their hands on my genitals, it was disgusting, my girlfriend was asked to take her pants off.” Hernandez says that they were both held behind bars for hours until the authorities asked her to sign a three-page document which they did not allow her to read completely but in which she was told she would free the authorities of any responsibility for their detention. “I signed,” she said, “because I did not want to spend a night in a jail cell.”

Panama? I would’ve thought that was more likely to happen somewhere else like in Peru or Ecuador (not saying that doesn’t happen in the rest of Latin America), but in Panama? Shame on them.

Leo and Armie Lock Lips for Hoover

The Advocate reports:

According to E! Online’s Marc Malkin and Brett Malec, Leonardo DiCaprio and Armie Hammer have filmed their kissing scene for the upcoming Clint Eastwood–directed biopic J. Edgar.

According to a source, the scene between the two actors is hot. DiCaprio is starring in the film as late FBI boss J. Edgar Hoover, while The Social Network’s Hammer plays his protégé and rumored lover Clyde Tolson.
“[They did] more [takes] than Clint normally does,” the source said. “They wanted to make it right … It’s a more involved scene than just the kissing … It was so sexy.”
Before production began, it was rumored the film had been stripped of its gay content. But screenwriter Dustin Lance Black told AfterElton.com: “To think that somehow you’re going to a make a movie about somebody like J. Edgar and you’re not going to learn what’s in his heart, that’s just not going to happen in a script that I write. It’s unfounded [the idea that the movie is being de-gayed.]”

Can’t wait!
